ADHD Student denied transfer to Transition school?

We Answered:

not exactaly--

having a medical diagnosis doesn't necessarily entitle someone to specuific services

if tehy are eligible for special ed throguh IDEA--they are entitled to a FAPE (free and appropriate eductaion)in teh LRE (least restrictive environment..

for some kids with ADHD this may be accommodations in the regular class--or part time in a special ed class--or full time in a special ed class--in ditsrict--or an out of disctrict palcement

ADHD can fall under tehIDEA classification of OHI (other health impaired)

some students with ADHD only need a 504 plan--which is less invovled--and generally only involves accommodatiosni n teh regular class

ADHD is a medically diganosed neuro disorder--if it were just a behavior probelm--the meds wouldn't work--what ever teh school administarion perosnal beleif--they are unethical to call it a behavbior probelm--by law it is a medical problem--and at least entietled to a 504 plan--if not an IEP

has he ever had an IEP/504

if not

did you request an evaluartionfor an IEP IN WRITING

look up PARENTAL RIGHTS IN SPECIAL EDUCATION and DUE PROCESS

eligibility is not only based on his diagnosis--but his skills and needs.....

ADHD is grounds for CONSIDERATION of a vocational/transistional school--its not automatic

1st--you need to see if teh school can provide accommodations in the regular classroom

than if not--in teh regular school--

if they can't provide either of these--tahn you look for an outside school..

it would be nice if every child could be provided every service in his home school--but this isn't always practical--often students can be provided better services in they is a group of 'peers' with similar difficulties within teh class/school..

andy child with an IEP can be sent to any other school-public or private as long a s teh home school pays tuition and the receiving school agrees.

you need to make the argument that they are NOT providing an APPROPRIATE EDUCATION--and a FAPE in teh LRE is the transistinal school
